Contrary to popular belief, even if motocross track on your own land is created solely for one's own use, such an investment cannot be made without formalities. Polish regulations treat motocross track as a construction project - and that means necessity:
- obtain decisions on building conditions (when there is no local development plan in the area),
- receipt building permits from the competent administrative authority,
- in the case of agricultural land, to carry out a procedure the exclusion of a plot of land from agricultural production (i.e. the so-called 'de-regulation').
By overlooking these formal requirements, we risk that the authorities construction supervision will classify our project as an arbitrary construction project, which may result in a demolition order. It is also advisable to familiarise yourself with the general changes in polish law 2025, which may affect construction and property ownership issues.
How do I find out if my plot of land is suitable for a motocross track?
Before purchase plots of land for a motocross track it is crucial to check carefully whether it is applicable on the local spatial development plan (MPZP). If so, you need to establish whether the plan:
- expressly authorises sports or recreational function (then implementation of the track may be possible),
- only provides for residential development - In such a case, the construction of the track will most often not be allowed.
The absence of a local plan means that it is necessary to apply for zoning decision (so-called WZ). The Authority may refuse to issue it, particularly if the planned track would be a potential source of noise or would disturb the character of the area.
What type of plot of land is best for a motocross track?

- design special acoustic barriers (earth embankments, planting of tall greenery),
- enter strictly defined hours of use (e.g. only at selected times),
- establish good relations with neighbours by communicating plans in advance.
Can a foreigner build a motocross track in Poland?
Citizens European Union may acquire real estate in Poland, however, planning for the construction of the track must be taken into account:
- for agricultural parcels >0.3 ha - NEB's right of first refusal and the obligation to farm for 5 years,
- for parcels <0.3 ha - no such restrictions for EU foreigners.
The safest option is to purchase a plot of land under 0.3 ha that is not classified as agricultural land.

Implementing your own track requires following a specific procedure:
- Land use plan analysis or obtaining a zoning decision
- Submission of building permit application
- Declassification of a plot of land (if necessary)
