1. GENERAL PROVISIONS AND CONTACT DETAILS
- The online shop is available at: www.bktkancelaria.pl.
- For complaints regarding orders, the customer should contact the Seller at the following email address: sekretariat@bktkancelaria.pl or by telephone: +48 606 608 089.
- These Terms and Conditions set out the rules for the use of the Shop, placing of orders, conclusion of contracts for the sale of products and complaint procedures.
- The Seller makes the Terms and Conditions available free of charge before using the Shop. Acceptance of the Terms and Conditions is a condition for making purchases.
- Product prices are quoted in PLN, EUR or GBP and are gross prices, including VAT.
- The product information, in particular descriptions, technical parameters and prices, is for information purposes only and constitutes an invitation to conclude a sales contract.
2. DEFINITIONS
In these Terms and Conditions the terms used shall mean:
- Seller - Beata Kielar-Tammert doing business under the name International law firm Beata Kielar-Tammert based in Wrocław, ul. Ofiar Oświęcimskich 19/307, 50-069 Wrocław, NIP: 6311514856.
- Customer / User - a natural person, a legal person or an organisational unit without legal personality who makes a purchase through the Shop.
- Consumer - a natural person concluding a contract with the Seller the subject matter of which is not directly connected with his/her economic or professional activity.
- Account - an individual account created by the customer to access the purchased products and services.
- Product - materials, digital content (e.g. e-books, online courses, training courses, electronic documents) and physical products offered in the Shop.
- Order - a declaration of intent by the customer to conclude a sales contract by selecting a product and making a payment.
- Payment operator - providers of electronic transactions, including Przelewy24 and Stripe Payments Europe Limited.
- Other terms used in the Rules shall retain the meaning given to them hereafter.
3. TECHNICAL REQUIREMENTS
- In order to use the Shop, internet access and a current version of a browser which supports cookies (e.g. Google Chrome, Mozilla Firefox, Safari) are required.
- The customer should have an active e-mail address and software capable of opening electronic files (pdf, doc, docx, xsl, mobi, pub, etc.), depending on the type of products ordered.
- The Seller makes every effort to ensure that the Shop functions properly, but is not responsible for interruptions due to technical reasons or failures beyond the Seller's control.
4. PLACING AND PROCESSING OF ORDERS
- Orders can be placed by selecting products on the Shop's website, adding them to the basket and finalising the transaction by clicking on the "Order with obligation to pay" button.
- To place an order, the Customer is required to provide the following details:
- name (or company name),
- address (country, street, building number, apartment number, postal code, city),
- telephone number,
- e-mail address.
- Acceptance of these Terms and Conditions and the Privacy Policy (available at privacy-policy) is a condition for placing an order.
- The sales contract is concluded as soon as the order is confirmed electronically (e-mail) by the Seller.
- In the case of cross-border orders (to consumers from other EU countries), the provisions of the consumer law of the customer's country of residence shall apply to the extent necessary to protect the customer's rights under the sales contract.
5. PRODUCT PRICES AND FORMS OF PAYMENT
- All product prices are gross prices and include VAT and other applicable charges.
- The seller reserves the right to change prices, introduce new products, promotions and discounts. These changes do not apply to orders placed before they take effect.
- Forms of payment available:
- Bank transfer - payment directly to the seller's account; the product will be dispatched once the payment has been credited.
- Electronic transfer - payment via the Przelewy24 system; it is necessary to provide identification data (at least the customer's first and last name) in the "Transfer title" field.
- The Customer has the option to use discount coupons if such a system is available in the Store.
- Once payment has been made, the customer will receive an electronic invoice (named or issued to the company if company details have been provided) within 3 working days.
6. DELIVERY OF PRODUCTS - COSTS, FORMS AND DEADLINES
- Delivery of the products is made to the address indicated by the Customer or electronically (in the case of digital products).
- Delivery methods available:
- postal delivery,
- courier delivery,
- parcels,
- personal collection,
- electronic delivery (for digital products).
- Delivery costs are quoted during the ordering process and are visible before the order is finalised.
- The lead time is between 3 and 5 working days after the payment is credited, unless otherwise agreed between the parties (e.g. in the case of individual services or online training).
7. ELECTRONICALLY SUPPLIED SERVICES
- The Seller provides services electronically, enabling the Customer, among other things, to conclude a contract for the sale of digital products and to use a user account.
- Services such as the sending of newsletters or the maintenance of the Account are provided at no extra charge, unless otherwise specified.
- Registration of an Account is voluntary, but allows access to additional functionalities of the Shop (e.g. order history, downloading of purchased products).
- The customer is obliged to keep the access data to the Account confidential and not to make it available to third parties.
8 COMPLAINTS
- The Seller shall be liable to the Consumer or Customer-Consumer for the non-conformity of the products with the contract in accordance with applicable laws, including the Consumer Rights Act and the Civil Code.
- To make a complaint, the Customer should send a written notification to the Seller's e-mail address, containing:
- identification data (name, address, e-mail),
- description of product defects (type, date of defect),
- expected demands.
- The Seller shall consider the complaint within 14 days of receipt. In the case of deficiencies in the application, the Customer will be called upon to complete the application.
- In the course of dealing with a complaint, the Seller processes the Customer's personal data solely for the purpose of dealing with the complaint.
9. WITHDRAWAL FROM THE CONTRACT BY THE CONSUMER
- The consumer and the customer-consumer have the right to withdraw from the contract within 14 days of its conclusion, without giving any reason.
- In order to exercise the right of withdrawal, the Customer should send an unequivocal statement of withdrawal (e.g. by e-mail or by means of the form available on the website of the Shop) before the expiry of the deadline.
- Upon receipt of the statement, the Seller shall refund to the Customer any payment made, using the same method of payment, unless the Customer agrees to another, cost-free method of refund.
- In the case of digital products, the right of withdrawal shall lapse if the Customer has agreed to access the product in advance and to start using it.
10. INTELLECTUAL PROPERTY RIGHTS, LICENCE, COPYRIGHT
- All content, electronic materials and products offered in the Shop are protected by copyright and are the property of the Seller.
- The Seller grants the Customer a non-exclusive, non-transferable licence to use the purchased products exclusively for his own purposes, in accordance with Polish law and applicable EU regulations.
- It is forbidden to copy, make available to third parties, modify or use the products in a way that infringes copyright without the prior written consent of the Seller.
- Any infringements may result in civil or criminal claims.
11. PERSONAL DATA AND COOKIES
- The administrator of the Client's personal data is the Seller, i.e. Kancelaria Prawa Międzynarodowego Beata Kielar-Tammert with registered office in Wrocław, NIP: 6311514856.

- The Customer's personal data is processed on the basis of:
- Article 6(1)(b) of the DPA - necessity for the conclusion and performance of the contract,
- Article 6(1)(c) of the DPA - fulfilment of legal obligations,
- Article 6(1)(f) RODO - legitimate interest of the Seller.
- The customer agrees to the processing of personal data for the purpose of processing orders, issuing invoices, handling complaints, as well as for marketing purposes (insofar as this does not violate the customer's rights).
- Data may be transferred to entities cooperating with the Seller (e.g. courier companies, payment operators, IT service providers) and, in the case of cross-border transactions, to third countries guaranteeing an adequate level of data protection (in accordance with the provisions of standard contractual clauses or binding corporate rules).
- The customer has the right to access, rectify, erase, restrict processing, data portability, lodge an objection, as well as the right to withdraw consent - without affecting the correctness of processing carried out prior to withdrawal.
- The data will be stored for the period necessary for the performance of the contract and for the duration of the applicable legislation, after which it will be deleted.

12. OUT-OF-COURT DISPUTE RESOLUTION AND REDRESS BY THE CONSUMER
- The Seller encourages the resolution of disputes through mediation. In the event of a dispute, the Customer may turn to:
- A permanent, amicable consumer court,
- Provincial Inspector of Trade Inspection,
- County (municipal) consumer ombudsman,
- ODR platform available at: https://ec.europa.eu/consumers/odr.
- In the case of contracts concluded with consumers residing in EU countries outside Poland, the Customer has the right to contact the relevant consumer protection authority in his/her country.
- Cases that are not resolved through mediation will be decided by the courts of competent jurisdiction in accordance with applicable law.
13. FINAL PROVISIONS
- Contracts concluded through the Shop and services provided electronically are concluded in the Polish language, however, in the case of cross-border sales to consumers from other EU countries, the provisions of the consumer law of the country of residence of the Customer shall apply with regard to the protection of his/her contractual rights.
- The Seller reserves the right to amend the Terms and Conditions in the event of changes in the law or in the terms and conditions of service. Amendments shall become effective as of the date of publication of the new version of the Terms and Conditions on the Shop website.
- If the contract was concluded before the Rules were amended, the version in force on the date of conclusion of the contract shall apply.
- In matters not covered by these Terms and Conditions, the provisions of Polish law and the relevant directives of the European Union shall apply.
- Any disputes arising from the contract shall be settled by the courts having jurisdiction over the Seller's registered office, taking into account the provisions on cross-border disputes if the Customer is a consumer.
